Are you renting a car and wondering what responsibilities fall on you? Liability for a rental vehicle is a topic that raises many questions. In this article, we will explain exactly what you are responsible for as a hirer and how to protect yourself from unpleasant financial surprises.

Basic principle - you are responsible

When you sign a rental agreement with Slawa Rent, you take full responsibility for the vehicle until it is returned. This means that you are responsible for the car as if you owned it - with all the consequences that entails.

What specifically are you responsible for?

Mechanical and bodywork damage

You are responsible for all damage caused to your rental - from minor scratches to dents to major collision damage. Standard AC insurance covers most cases, but you will usually have to pay an excess, which ranges from a few hundred to a few thousand depending on the vehicle.

Vehicle theft

If your car is stolen, it is insured, but your liability relates to the circumstances of the incident. If you have neglected basic precautions (e.g. left the keys in the ignition), you may be partially or fully financially liable. Always park in secure areas, lock your doors and activate your alarm.

Traffic fines and tolls

All fines for traffic offences committed during rental are charged to you. The same applies to tolls for motorways, car parks, pay zones and vignettes. The rental company has the right to pass on your details to law enforcement agencies and charge an administrative fee for handling the case.

Incorrect fuel

Filling up with the wrong type of fuel is one of the most costly mistakes. If you pour petrol into a diesel (or vice versa), it can destroy the engine. Repair costs often amount to several thousand zloty and are fully charged to the tenant. Always double-check before you fill up!

Loss of keys and documents

If you lose your keys, registration card or vehicle card, you are responsible. The cost of making new keys (especially with remote control) ranges from several hundred to over a thousand zloty. Documents also need to be recreated, which involves time and expense.

Destruction inside the vehicle

You are responsible for the condition of the interior - from the upholstery to the multimedia systems. Stains that are difficult to remove (drinks, food), burn marks, equipment damage or excessive soiling may result in additional charges for professional cleaning or repair.

How do you protect yourself from high costs?

Accurate protocol on receipt and return

This is the most important rule! When collecting the car walk with a Slawa Rent employee around the vehicle and carefully check its condition. Any existing damage should be noted on the record. Also take your own photos from all sides - this is your safeguard. Do the same on return to document that no new damage has occurred.

Insurance and deductible

A standard rental contract includes third party and AC insurance, but with a deductible. This means that in the event of damage, you pay a certain amount (e.g. PLN 1500-3000) and the rest is covered by insurance. Some rental companies offer the option to reduce or waive the excess for an additional fee - worth considering with more expensive vehicles.

Immediate reporting of problems

Conduct in accordance with the contract

Read the regulations carefully and abide by them. Do not go abroad without permission, do not exceed the permitted limits, do not share your car with unauthorised persons. Breaking the terms and conditions of the contract may deprive you of your insurance cover.

In the event of an accident - the correct procedure

When a collision or accident occurs: (1) secure the scene, (2) call the police (if required), (3) take accurate photographic documentation, (4) notify the rental company immediately, (5) do not admit fault - this will be determined by the relevant services. Fill in the perpetrator/injured person declaration (white and blue sheet) available in the vehicle documents.

Criminal liability

Remember that in addition to your financial responsibility, you also bear criminal liability for offences committed with a hired car. Driving under the influence of alcohol, significantly exceeding the speed limit or causing a fatal accident are all situations that can end in a court sentence. The rental company does not protect you from the legal consequences of your actions.

When are you not liable?

There are situations in which the rental company cannot charge you:

Natural wear and tear - normal signs of contractual use (e.g. light soiling, minor operating scratches) do not constitute grounds for a claim.

Hidden defects - if the car had a manufacturing or mechanical defect not caused by your use, you are not responsible for the consequences.

Force majeure - damage caused by natural phenomena (hail, fallen tree during a storm) can be covered by insurance without your contribution.

Disadvantages existing prior to rental - if the damage was present before acceptance and was documented in the protocol, you are of course not responsible for it.
