1.
These General Terms and Conditions for Car Rental set out the terms and conditions under which the Lessor gives the car to the Renter for use.
2.
The Tenant warrants that:
-the data he/she has provided is correct,
– posiada pełną zdolność do czynności prawnych,
-has the necessary licences to drive the vehicle and in particular has not been deprived, by a decision of a competent authority, of the right to drive a motor vehicle,
-there are no proceedings pending against him which could lead to his driving licence being withdrawn.
3.
Duration of contract :
The contract is concluded for a fixed period, each time indicated therein.
The hirer is obliged to return the vehicle on the date and time specified in the contract.
In the event of failure to return the vehicle within the period specified in the contract, the lessee undertakes to pay the contractually agreed remuneration for each commenced day of rental beyond the period specified in the contract, as well as a contractual penalty of not less than PLN 1000.
4.
Payment :
On the day of signing the rental contract, the Tenant shall pay the remuneration to the Landlord for the rental period shown in the contract. In special cases, the parties may agree on other payment terms and deadlines. In the case of long-term contracts, payment for
each month started is paid in advance by the 10th day of the month started, failure to make a payment terminates the contract immediately.
The remuneration includes the VAT due.
On the day of the return of the vehicle, the Hirer shall be obliged to pay any amounts due under the provisions of this contract.
5.
Car collection :
The hirer receives the vehicle described in the rental contract in good working order.
The fuel tank was filled to capacity and is to be returned as such. In the event that the hirer returns the vehicle with a different fuel level, he undertakes to
to pay the value of the missing fuel and a handling fee of PLN 100
6.
Responsibilities of the Tenant.
The tenant undertakes:
-to use the vehicle for its intended purpose and to keep the car clean,
-drive the vehicle personally, do not sublet or transfer the vehicle for free use to third parties,
-do not make any changes to the vehicle,
-Do not carry out any repairs yourself and, in the event of a breakdown, notify the Lessor immediately,
-not to use the vehicle in any sports competitions, rallies or in any election campaigns,
-notify the Lessor immediately of any traffic incident (collision, accident, theft) and notify the police at the scene of the accident in order to draw up an appropriate protocol regarding the circumstances of the incident,
-to perform, at his/her own expense and effort, daily maintenance of the vehicle, i.e. checking and replenishing engine oil, coolant, brake fluid, checking operation of lights, etc., -to perform, at his/her own expense and effort, daily maintenance of the vehicle. The Lessor shall cover the repair costs incurred due to negligence in daily maintenance of the vehicle (seizure of the engine - lack of oil, overheating of the engine - lack of coolant, etc.).
It is prohibited to :
- towing of other vehicles with the rental car
-exceeding the permitted load capacity
7.
The Lessor shall not be liable for any traffic violations or fines imposed on the Lessee during the Lessee's use of the vehicle.
8.
Tenant's liability.
It is forbidden to leave the vehicle without proper security and, in particular, not to leave documents and the key in the vehicle.
In the event of the theft of the vehicle with documents and/or keys, the Hirer shall be held fully responsible for the resulting damage.
In the event that the vehicle is returned without the key or a set of documents (registration certificate, insurance policy), the hirer is entitled to the following benefits
the right to charge the tenant the following costs :
– 800 zł + VAT za zgubienie kluczyka.
– 1000 zł + VAT za zgubienie dokumentów.
The hirer bears full responsibility for damage caused through his/her fault by using the vehicle.
9.
Vehicle insurance.
In the event of damage or destruction to the vehicle, the Renter shall pay the Lessor appropriate compensation within 7 days of being summoned by the Lessor.
The hirer's liability is agreed as the so-called "deductible" in the event of total damage of PLN 6,000, and in the event of partial damage of PLN 3,000 (payment for vehicle downtime, repair time, formalities).

-intentional damage to the vehicle,
-Damage while driving while intoxicated, using drugs or psychotropic substances or without a valid driving licence,
– w przypadku, jeżeli kierowca zbiegł z miejsca wypadku,
-Damage caused when the person driving was a person not authorised by the lessor,
-innych szczególnych przypadków wynikających z ogólnych warunków umów ubezpieczeniowych i polis.
In the event that the vehicle is involved in a collision resulting in damage that cannot be repaired (repair proves uneconomic) or the vehicle is stolen and the insurer refuses to pay the full amount of compensation for any reason, the hirer will be responsible for paying the difference.
10.
The Civil Code will apply to matters not covered by this agreement.
